A Custer County District Court judge has denied a motion by attorney's seeking a continuance in the trial of a Texas man who faces the death penalty in connection with a December 2015 shooting spree that killed two people. Counsel for Jeremy Doss Hardy sought to have the trial date of June 13th moved to a later date citing they would not be ready to try the capital case as it involves significant preparation. The multiple charges against Hardy, includes two counts of first degree murder-malice aforethought, for the shooting deaths of Jeffery Kent Powell of Arapaho and Bille Jean West of Lone Wolf on Interstate 40 in western Oklahoma. In his ruling, Judge Doug Haught says cases must be handled in a timely manner and the defense has had 15 months to prepare and investigate. The judge also overruled a motion to stay his ruling of keeping the June 13th trial date pending appeal to the Oklahoma Court of Criminal Appeals.
